Terms of service

1.What kmarto is
kmarto ("kmarto", "we") is an online app for running a business: billing, stock, quotes, payments, reports and a booking page for your customers, at yourshop.kmarto.com. By creating a shop or using kmarto you ("you", the business) agree to these terms. If you use kmarto for a company or firm, you confirm you're allowed to agree for it.
2.Your account
- You sign in with your Google account and confirm your mobile number once. Keep that Google account secure - anyone who can sign in to it can open your shop.
- You can add staff. You're responsible for what they do in your shop, and for removing them when they leave.
- The details you give us (shop name, contact details, GSTIN) must be true and kept up to date.
3.Free trial and Premium
- Every new shop gets a free trial (7 days today). No card is needed.
- When the trial or a paid period ends, your shop becomes view-only: you can still sign in, see everything and download it, but adding or changing things - and your booking page - need Premium.
- Premium is paid monthly or yearly, for each kind of business you run, at the prices shown on kmarto.com. Prices don't include GST. We'll tell you at least 30 days before a price change applies to you.
- Unless the law says otherwise or we agree with you, fees already paid aren't refunded for the unused part of a period.
4.Your data
- Your shop's data belongs to you - your products, prices, orders, customers, payments and everything else you put in. We store and process it only to run kmarto for you, as described in our Privacy policy and on Your data.
- You can download all of it at any time, on any plan, and delete your shop whenever you want (Admin settings → Your data).
- kmarto support looks inside your shop only when you switch on support access, and only to help you.
- For your customers' details (for example from your booking page), your business decides how they're used and we process them for you. You're responsible for having a proper reason to keep and contact them - for example, not messaging people who asked you not to.
5.Your business, your responsibilities
- You're responsible for your business following the law: the licences it needs (for example to store or sell fireworks), what you sell and to whom, your prices, and your taxes.
- kmarto works out GST and makes invoices from the details you enter. Check them - you're responsible for the invoices you issue and the returns you file, and for keeping your records as long as the law requires.
- Orders, quotes and payments on your booking page are between you and your customer. kmarto isn't a party to them and doesn't collect money on your behalf.
6.Fair use
Please don't use kmarto to:
- break the law, sell banned goods, or cheat anyone;
- send spam or messages people didn't ask for;
- try to get into other shops' data, attack or overload the service, or copy or resell kmarto itself;
- upload anything you don't have the right to use.
7.Keeping kmarto running
We work to keep kmarto available and your data safe, and we fix problems as soon as we can. Sometimes we'll need short breaks for maintenance, and things outside our control (internet or cloud outages) can interrupt the service. We improve kmarto all the time; if we remove something important you rely on, we'll tell you in advance.
8.Ending or pausing
- You can stop using kmarto and delete your shop at any time. Deleting gives you 7 days to change your mind; after that your data is erased for good.
- We may pause or close a shop that seriously or repeatedly breaks these terms or the law. Unless it's urgent, we'll warn you first and give you time to download your data.
9.Liability
kmarto is provided "as is". To the extent the law allows, we aren't liable for indirect losses such as lost profit or lost business, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before it. Nothing here limits liability that can't be limited by law.
10.Changes to these terms
If we change these terms in a way that matters to you, we'll show it on this page and tell you in the app or by email before it applies. Using kmarto after that means you accept the new terms.
11.Law and disputes
These terms are governed by the laws of India. If there's a problem, please write to us first - most things can be sorted out quickly. Any dispute that can't be settled goes to the courts of India.
12.Contact
